TERMS OF SERVICE

Welcome to VesperaGlow. These Terms of Service (the “Terms”) govern your access to and use of our website, online store, products, content, features, and related services (collectively, the “Services”).

Nothing in these Terms excludes, restricts, or overrides any rights or remedies that cannot lawfully be excluded under applicable consumer-protection law.
1. ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a binding contract in your place of residence to place an order. If you are under the applicable legal age, you may use the Services only with the involvement and consent of a parent or legal guardian.
You agree to provide accurate, current, and complete information when using the Services or placing an order. If you create an account, you are responsible for keeping your login details confidential and for activity carried out through your account. Please contact us promptly if you believe your account has been accessed without authorization.
We may refuse, suspend, or close an account where reasonably necessary to protect the Services, prevent fraud or unlawful activity, or enforce these Terms.
2. PRODUCT INFORMATION AND SAFE USE
We aim to describe and display our products as accurately as possible. However, colors and appearance may vary slightly depending on your screen, lighting, photography, and device settings. Packaging and minor product details may also change where this does not materially affect the product’s function or quality.
Product images are illustrative. Any included accessories, specifications, dimensions, compatibility information, or package contents are stated on the relevant product page. Please review that information before ordering.
You are responsible for using products in accordance with the supplied instructions, warnings, and intended purpose. Keep electrical products away from water and excessive heat, maintain adequate ventilation, use only compatible power sources and accessories, and supervise children where appropriate. When using a projector, do not stare directly into the illuminated lens or aim the beam into anyone’s eyes. Do not disassemble, alter, or misuse a product.
We may update product descriptions, correct errors, limit quantities, or discontinue products at any time. Changes will not affect an order we have already accepted unless required for legal, safety, or supply reasons and agreed with you where necessary.
3. ORDERS AND CONTRACT FORMATION
By submitting an order, you offer to purchase the selected products under these Terms. The automated order-confirmation email acknowledges that we received your order but does not necessarily mean that we have accepted it.
A binding sales contract is formed when we send you a dispatch confirmation or another explicit acceptance notice, unless mandatory law in your jurisdiction provides otherwise. Each dispatch may constitute a separate sales contract if products from one order are shipped separately.
We may decline or cancel an order before acceptance for legitimate reasons, including product unavailability, an obvious pricing or description error, suspected fraud, payment failure, shipping restrictions, or a breach of these Terms. If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.
Please review your order details carefully before submitting it. If you wish to change or cancel an order, contact support@vesperaglow.com as soon as possible. We cannot guarantee that changes or cancellations will be possible after processing or dispatch has begun. This does not affect any statutory cancellation or withdrawal rights you may have.
Products are sold for personal or household use unless we expressly agree otherwise. You must not purchase products for unauthorized resale, export, or unlawful use.
4. PRICES, TAXES, AND PAYMENT
Prices are shown in the currency displayed at checkout. Any applicable taxes included in, or added to, the price will be shown as required by law. Shipping charges and any other applicable costs will be disclosed before you complete your purchase.
For international orders, customs duties, import taxes, or local handling fees may apply. Where these charges are not collected at checkout, you may be responsible for paying them to the relevant authority or carrier. Please review our Shipping Policy for details.
We may change prices, discounts, and promotions at any time, but changes will not affect an order already accepted. If a price is clearly incorrect, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected item and issue a refund.
You authorize us and our payment providers to charge the payment method selected at checkout. You confirm that you are authorized to use that payment method and that the information you provide is accurate. Payment processing may be subject to additional terms and security checks imposed by the payment provider.
5. SHIPPING, DELIVERY, AND RISK OF LOSS
Available shipping methods, estimated delivery times, and charges are displayed at checkout or described in our Shipping Policy, available here: SHIPPING POLICY Delivery dates are estimates unless we explicitly agree to a guaranteed date.
We will use reasonable care to dispatch and deliver your order within the stated timeframe. Delays may occasionally occur because of carrier disruption, customs processing, severe weather, public emergencies, supply issues, or other circumstances outside our reasonable control. If a significant delay occurs, we will provide available updates and any remedies required by applicable law.
You are responsible for providing a complete and accurate delivery address. If an order cannot be delivered because the address supplied was incorrect or incomplete, additional redelivery costs may apply where permitted by law.
Where consumer law applies, the risk of loss or damage remains with us until you, or a person identified by you other than the carrier, takes physical possession of the products. If you independently appoint a carrier that we did not offer, risk may pass when the products are handed to that carrier, to the extent permitted by law.
If your order is missing, arrives damaged, or contains the wrong product, contact support@vesperaglow.com promptly with your order number and relevant photos so we can investigate and provide an appropriate solution.
6. RETURNS, WITHDRAWAL RIGHTS, REFUNDS, AND LEGAL GUARANTEES

Our voluntary return policy is additional to, and does not replace, any mandatory rights available to you.
If your order is delivered within the European Union, you may have a statutory right to withdraw from an online purchase within 14 days of delivery without giving a reason, subject to applicable exceptions. Instructions for exercising that right are set out in our Return & Refund Policy.
Consumers in the European Union also benefit from a minimum two-year legal guarantee for goods that are faulty, do not match their description, or do not perform as advertised, subject to applicable national law. Other countries may provide different or additional legal guarantees.
Nothing in these Terms limits your right to a repair, replacement, price reduction, refund, cancellation, or other remedy where required by applicable law.
7. PROMOTIONS, DISCOUNTS, AND GIFT CARDS
Promotions, discount codes, bundles, giveaways, and gift cards may be governed by additional terms displayed with the offer. Unless stated otherwise, promotions are subject to availability, cannot be combined, have no cash value, and may be limited by time, product, customer, or region.
We may refuse or cancel a promotion that has been used fraudulently, unlawfully, or contrary to its stated conditions. Any cancellation will not affect rights that cannot lawfully be excluded.
The Services and their contents—including our name, logos, branding, designs, text, graphics, photographs, videos, audio, product presentation, and website layout—are owned by or licensed to VesperaGlow and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, lawful, and non-commercial purposes. You may not copy, reproduce, modify, distribute, sell, license, publicly display, scrape, exploit, or create derivative works from any part of the Services without our prior written permission, except where applicable law expressly permits it.
VesperaGlow names, logos, product names, and slogans may be trademarks of VesperaGlow or its licensors. Shopify and its related marks belong to Shopify or its affiliates. All other trademarks belong to their respective owners.
9. CUSTOMER REVIEWS AND OTHER SUBMISSIONS
If you submit a review, photograph, video, suggestion, comment, or other content (“User Content”), you remain responsible for it and confirm that you have the rights needed to share it.
You grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, use, reproduce, adapt, publish, translate, and display your User Content for operating, improving, and promoting the Services, subject to applicable privacy and consumer laws. This license continues only for as long as reasonably necessary for those purposes, except where content has already been used in published materials or retention is legally required.
User Content must be truthful and must not infringe another person’s rights, disclose confidential information, contain unlawful or harmful material, impersonate another person, or include malware, spam, or deceptive advertising. Any incentive received for a review must be clearly disclosed.
We may moderate or remove User Content where reasonably necessary, but we are not required to publish every submission. We will not manipulate reviews or suppress genuine negative reviews solely because they are unfavorable.
10. ACCEPTABLE USE
You may use the Services only for lawful purposes. You must not:
• Violate any applicable law or another person’s rights.
• Commit or attempt fraud, payment abuse, identity theft, or other deceptive activity.
• Upload or transmit malware, malicious code, or harmful content.
• Interfere with the security, availability, or operation of the Services.
• Bypass access controls, rate limits, or protective measures.
• Collect personal information about others without lawful authority.
• Use the Services to send spam, phishing messages, or unauthorized advertising.
• Impersonate another person or misrepresent your identity or affiliation.
• Use automated means to access or extract data from the Services in a manner that places an unreasonable load on the Services, violates law, or infringes our rights.
We may take proportionate action, including restricting access or cancelling affected orders, where we reasonably believe this section has been violated.
11. THIRD-PARTY SERVICES AND LINKS
The Services may include links to, integrations with, or tools provided by third parties, such as payment processors, delivery providers, analytics services, review platforms, and social networks. Those third parties may apply their own terms and privacy policies.
We do not control independent third-party websites or services and are not responsible for their content, availability, or practices. Your use of them is at your discretion. This section does not exclude responsibility we have for subcontractors or service providers where applicable law makes us responsible.
12. RELATIONSHIP WITH SHOPIFY
VesperaGlow is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are made directly from VesperaGlow. Shopify is not the seller of our products and is not responsible for fulfilling orders, providing customer service, or resolving claims relating to products purchased from us.
To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising solely from a purchase transaction between you and VesperaGlow. Nothing in this section limits rights or claims that cannot lawfully be waived.
13. PRIVACY AND DATA PROTECTION
Our collection and use of personal information are described in our Privacy Policy, available here: PRIVACY POLICY . Please read it carefully.
Because Shopify hosts our store, Shopify processes certain personal information to operate and improve its platform. Information may also be processed by payment, shipping, analytics, customer-support, and other service providers as described in our Privacy Policy.
14. AVAILABILITY, ERRORS, AND CHANGES TO THE SERVICES
We aim to keep the Services accurate, secure, and available, but we do not guarantee uninterrupted or error-free operation. We may maintain, update, suspend, or change any part of the Services where reasonably necessary.
Occasionally, information may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, availability, shipping costs, or delivery estimates. We may correct such information and, where necessary, contact you about an affected order. We will not make material changes to an accepted order without providing the remedies required by law.
15. DISCLAIMERS
To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, or free from technical errors.
Products are provided with the express warranties stated on the relevant product page and with all statutory warranties, guarantees, and conformity rights required by applicable law.
We do not exclude or disclaim any warranty, guarantee, condition, or consumer right that cannot lawfully be excluded. In particular, this section does not affect mandatory rights relating to product conformity, safety, title, durability, repair, replacement, price reduction, or refund.
16. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, willful misconduct, gross negligence where it cannot be limited, breach of mandatory consumer rights, defective products where liability cannot be excluded, or any other liability that cannot lawfully be limited.
Subject to the paragraph above and to the fullest extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the contract was formed, or for business losses suffered by a person purchasing primarily as a consumer.
If you use the Services for commercial or business purposes, our total liability arising from a particular order or event will not exceed the greater of the amount you paid for the affected order or the minimum amount required by applicable law. This limitation does not apply where prohibited by law.
17. YOUR RESPONSIBILITY
You are responsible for losses we reasonably incur as a direct result of your intentional unlawful use of the Services, fraud, or material breach of these Terms. You will not be responsible to the extent that a loss resulted from our own act or omission, was not reasonably foreseeable, or cannot lawfully be assigned to you.
Nothing in this section creates an indemnity against a consumer that would be unfair or unenforceable under applicable law.
18. SUSPENSION AND TERMINATION
You may stop using the Services at any time. We may suspend or terminate your access where reasonably necessary because of a material breach of these Terms, fraud, unlawful conduct, security risk, or discontinuation of the Services.
Termination does not affect rights and obligations that arose before termination. Provisions that by their nature should continue—including intellectual property, liability, governing law, and dispute provisions—will survive termination.
19. GOVERNING LAW AND DISPUTES

20. CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Services, our business practices, or applicable law. The current version will be posted on this page with an updated revision date.
Material changes will apply prospectively and will be communicated where required by law. Changes will not retroactively alter an order or contract already accepted unless the change is legally required or you agree to it.
21. GENERAL PROVISIONS
Severability. If any provision of these Terms is found to be unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
No waiver. If we do not immediately enforce a provision, we do not waive our right to enforce it later.
Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer our rights or obligations as part of a merger, acquisition, restructuring, sale of business, or transfer to an affiliate, provided that your mandatory rights are not reduced.
Entire agreement. These Terms, together with the policies and terms expressly incorporated by reference, form the agreement between you and us regarding the Services. They do not exclude representations or rights that cannot lawfully be excluded.
Headings. Section headings are provided for convenience and do not affect interpretation.
